a)!The permissions granted by this Permit are strictly limited to the Property described in <br />paragraph three, above, with the following exception: the operations permitted in <br />paragraph two, above, may not be conducted north of Clearwater Creek. <br />b)!Definition: Topsoil Earthen material meeting the requirement of the Minnesota <br /> <br />c)!All activity on the Property must comport with the Minnesota Creek Buffer law, <br />Minnesota Statute Section 103F.48, by keeping a fifty (50) foot wide buffer from <br />Clearwater Creek except at such time as temporary nonvegetated <br />maintenance and mining of topsoil, and backfill within that buffer. <br />d)!All topsoil processing activities, including stockpiling of topsoil shall be conducted entirely <br />within the easterly 680 feet of the property south of Clearwater Creek (approx. 13 acres <br /> Area A on Exhibit A), and shall not encroach within fifty (50) feet of the top of the <br />ordinary high water mark of Clearwater Creek within the area described above. <br />e)!Mining/stripping of topsoil and backfill of the mined/stripped area with existing, on-site <br />material shall be allowed on the entire property described and included in this Permit <br />(Areas A & B on Exhibit A). Generally, these operations may not encroach within fifty (50) <br />feet of the top of the ordinary high water mark of Clearwater Creek, however, operations <br />may encroach within ten (10) feet of the top of the ordinary high water mark of <br />Clearwater Creek for a period no longer than necessary to mine material near the Creek. <br />Thereafter, the fifty (50) foot buffer shall be resorted. <br />f)!c <br />above, may be disturbed and without vegetative cover at any given time. <br />g)!Existing green strip along Clearwater Creek shall not be disturbed. <br />h)!Operating hours shall be limited to 7:00 a.m. to 6:00 p.m. Monday through Saturday. <br />i)!Permittee shall endeavor to limit speed of trucks entering or leaving the site to 25 miles <br />per hour. <br />j)!The following erosion and sediment control measures shall be followed: <br />1.!Maintain double row of silt fence around perimeter of site while there is exposed <br />soil. Fences shall be maintained through the duration of this permit in accordance <br />with MPCA best practices. <br />2.!ordinary high water mark of Clearwater Creek for <br />stockpiling and black dirt processing operation, except temporarily by maintaining <br />a ordinary high water mark of Clearwater Creek for <br />mining/stripping operation. minimum buffer shall be maintained no <br />longer than necessary to conduct mining/stripping operations, and shall be <br />immediately restored on the conclusion of mining/stripping operations. <br />3.!Limit the slopes on stockpiles to a 3:1 ratio <br />4.!Maintain a rock construction entrance per approved city detail plates at the <br />entrance to the site and keep the drive and adjoining street free of mud and dirt. <br />Upon notice by the city of excessive accumulation of dirt or mud in the street, <br />Permittee shall clean and\\or sweep within four hours. A pick-up style sweeper <br />shall be used for all street cleaning activities.
