u)!An administrative fine of $500 per day shall be levied for uncorrected violations of the <br />above conditions. The fine shall be levied per day, per condition violated. <br />5. This Permit shall be effective April 1, 2019 January 2, 2021, and shall expire aton December <br />31, 20202022. Not later than December 31, 20192021, all excess non-topsoil material <br />remaining on the site shall be hauled away and/or leveled and the site graded and seeded <br />to prevent erosion, in conformance with law. All in-place topsoil intended for mining, shall <br />be stockpiled, or removed from the site. Not later than December 31, 20202022, all topsoil <br />and other material shall be removed from the site orshall be graded (leveled) in a manner <br />consistent with a pad-ready building site. Not later than December 31, 20202022, all <br />equipment shall be removed from the site. After such date, the City may take all measures <br />necessary to enforce the provisions of this Permit, including but not limited to creating a <br />pad-ready building site on the Property, and assess costs for same, against the Property. <br />Extensions to the deadlines in this Permit may be granted upon application and approval by <br />City. <br />6. This Permit shall become effective once the applicant submits an Irrevocable Letter of Credit <br />(LOC), in a form acceptable to the city attorney, in the amount of $200,000, which shall <br /> ability to enforce <br />and remediate issues related to this Interim Use Permit which may arise during or after the <br />termination of this Permit. <br />7. Criminal Penalty.
