That part of said North Half of the Northeast Quarter of the Southeast Quarter of <br />Section 14, Township 31 North, Range 22 West, Anoka County, Minnesota, <br />described as follows: Beginning at the Southeast corner of said North Half of the <br />Northeast Quarter of the Southeast Quarter; thence North 125 feet along the east <br />line of said Section 14; thence westerly 348.5 feet on a line parallel to the south <br />line of said North Half of the Northeast Quarter of the Southeast Quarter; thence <br />southerly 125 feet to a point on the south line of said North Half of the Northeast <br />Quarter of the Southeast Quarter; thence easterly 348.5 feet to the place of <br />beginning. <br />3. Conditions. This permit is issued subject to the following conditions: <br /> <br />A. The Property and each lot on the Property shall be used in a manner consistent <br />with Exhibit A as it pertains to the follow subjects: <br />Minimum lot area. <br />Minimum lot width. <br />Front setback. <br />Rear setback. <br />Side setback. <br />B. Developer shall dedicate easements adjoining the County road right of way <br />along the east side of the property as required by Anoka County. <br />C. Developer shall dedicate easements to wetlands and outlots on the Property <br />for their use, maintenance, and protection in a manner consistent with the <br />Permit. <br />D. The Property shall be subject to a perpetual homeowne <br />providing upkeep, maintenance, and protection of the outlots on the Property, <br />the trail connecting the Property to Brian Drive, and the wetlands on the <br />Property. Same shall be a deeded covenant for each of the 24 lots and outlots <br />on the Property. <br />E. The Property shall be subject to the standards and requirements of the City of <br />Centerville, Rice Creek Watershed District, Anoka County, Army Corp of <br />Engineers, FEMA, Minnesota DNR, and any other agency having jurisdiction <br />over the project and shall secure and file with the City, any permits required <br />by outside agencies. <br />F. Approval of the elements of this Conditional Use Permit is subject to staff and <br />city engineer review for conformance with city code and standards. <br /> <br />5. Criminal Penalty. Violation of the terms of this permit is a criminal misdemeanor. <br /> <br />4 <br /> <br />
