1) Landowner will obey all laws and regulation necessary to operate this type of <br />facility, and will obtain and maintain, in good standing, all licenses necessary to <br />operate this type of facility. <br /> <br />2) A facility operated on the Subject Property shall operate pursuant to the follow <br />license(s) \[INSERT NAME OF LICENSES HERE\]. <br /> <br />3) The facility will have a sufficient number of trained personnel at the facility at all <br />times who are capable to perform lift assists and will follow protocol and <br />licensure requirements. <br /> <br />4) Residents and users of the Subject Property are encouraged to call for <br />emergency services provided by the City and other governmental agencies. A <br />facility operated on the Subject Property shall operate pursuant to a plan, <br />approved by the City, to manage the these emergency <br />services. This plan shall set forth the method, manner, and procedures employed <br />by the facility to provide for the needs of its residents while avoiding the <br />excessive consumption of these emergency services. This plan shall balance the <br />needs of the facility and its residents for consumption of these emergency <br />services with their cost to local government and taxpayers. If the City finds that <br />the becomes excessive, the <br />Landowners agrees to compensate the City for excessive consumption of <br />emergency services. This plan shall be annually approved the City. <br /> <br />5) Users of the Subject Property will produce no noise, vibrations, air pollution, light <br />pollution, fire hazards or noxious emissions which will disturb or endanger <br />neighboring properties. <br /> <br />6) Users of the Subject Property will create no act of public nuisance or disorderly <br />conduct, as defined pursuant to the City Code of Ordinances or pursuant to <br />State Law. <br /> <br />7) Screening of the trash enclosure will be reviewed and approved by the City <br />Planner. <br /> <br />8) Signage for the project will be reviewed and approved by the City Planner. <br /> <br />9) Landowner will follow the applicable standards and requirements of the City of <br />Centerville City Code, Rice Creek Watershed District, Anoka County, Army Corp <br />of Engineers, FEMA, Minnesota Department of Natural Resources, and any other <br />agency having jurisdiction over the Subject Property and shall secure those same <br />files with the City. <br /> <br />10) Landowner will construct and maintain the Subject Property and improvements <br />contained thereon, in accordance with the Site Plan and Building Plans as <br />approved by the City. <br /> <br />3 <br />Version 03/26/2021 <br /> <br />
