<br />City ofCenterviJle <br />Council Meedus Minutes <br />July 26, 2006 <br />Council Member Pur agreed to leave it as it is and in five years renegotiate the contract. <br /> <br />Council Member Lakso indicated she does not want to commit to something that goes out <br />25 years. <br /> <br />Council indicated a willingness to accept the terms if it were only a five year period but <br />not a 25 year period with automatic renewals. <br /> <br />Council Member Paar indicated that more money would be made if left as it is but the <br />other one guarantees 72 months at a lower amount. <br /> <br />Council asked Staff to review and come back with further information. <br /> <br />7. Removal QfllrAin9 Structure from Riaht-of:.Way - Heritage Street <br /> <br />City Engineer Statz indicated the issue is who pays to remove it, the owner of the <br />property or the City. He then said that Staff feels that the engineer memo stated a request <br />for more detail on the structure and none was provided so Staff feels that clarification <br />was not provided when requested and it should be the owner's responsibility to move the <br />structure. <br /> <br />City Administrator Larson indicated he asked Tom W'1lharber this afternoon to check to <br />see if the beehive catch basin and manhole structure would work with the draintile and <br />was told he would talk to the engineer and Rice Creek and contact StatI <br /> <br />city Administrator Larson indicated that the Church received a price to move it and the <br />price is $5,000 and they do not think it should be their cost. <br /> <br />Council Member Lee disagreed and said he feels that the Church should move it and pay <br />to do so. <br /> <br />City Attorney Glaser agreed that the City is not liable. <br /> <br />Council Member Paar indicated that the trail easement was discussed numerous times but <br />nothing like this was understood to be like what is actually out there. He then said that he <br />does not think: that this should be paid for by the City as more detail was requested and <br />not received.
