same. Such Final Plat or Other Documents shall contain all easements required for the construction <br />and maintenance of improvements for the development. <br />3. RIGHT TO PROCEED. Within the Land, the Developer may not grade (except <br />as authorized in a Permit issued by the City) or otherwise disturb the earth, remove trees, construct <br />sewer lines, water lines, streets, utilities, public or private improvements, or any buildings until all <br />the following conditions have been satisfied: 1) this Agreement or subsequent amendments or <br />codicils have been fully executed or consented to by all parties, including owners, lessors, lessees, <br />and mortgage holders, and filed with the City Administrator and recorded against the Land, 2) the <br />necessary security has been received by the City, 3) the Final Plat has been approved by the City <br />Council and is in a form ready for recording with the Anoka County Recorder's Office, 4) the <br />necessary easements, rights -of -ways, covenants or other land use documents have been recorded <br />against the Land, and 5) the City Administrator has issued a letter that all conditions have been <br />satisfied and that the Developer may proceed. <br />The Final Plat will not be released to the Developer and may not be recorded until the <br />necessary Security, as hereinafter defined, has been received and accepted by the City. The City <br />Administrator shall issue the notice to proceed within two (2) business days after receipt and <br />acceptance of the Security. <br />4. OTHER DEVELOPMENT. The conditions contained in this Agreement apply <br />to all parcels during all phases of this development. As to the Outlots in the Final Plat which have <br />not been approved for development at the time this Agreement is executed, the final plans for <br />development or construction on those parcels are currently unknown to the Parties to this <br />Agreement. At such time as development of the Outlots occurs, the owner of the Outlot and/or the <br />Developer shall make application to the City for an Amendment to the Final Plat.
