property damage which may arise out of Developer's work or the work of its subcontractors or by <br />one directly or indirectly employed by any of them. Limits for bodily injury and death shall be <br />not less than $500,000 for one person and $1,000,000 for each occurrence; limits for property <br />damage shall be not less than $200,000.00 for each occurrence; or a combination single limit policy <br />of $1,000,000 or more. The City shall be named as an additional insured on the policy, and the <br />Developer shall file with the City a certificate evidencing coverage prior to the City approving this <br />Development Agreement. The certificate shall provide that the City must be given ten (10) days <br />advance written notice of the cancellation of the insurance. The certificate of insurance shall <br />substantially comply with the form attached hereto as Exhibit C. <br />25. BLOCK 1 — SPECIAL ISSUES. <br />A. STREET A. <br />The City approved the Preliminary Plat with a dedicated street between 20th Avenue North <br />and 21st Avenue North. At the time of Plat approved, the City approved development plans for <br />construction of this street from 21St Avenue North and ending in a cul-de-sac on Block 1, Lot 2. <br />The parties hereto acknowledge that at the time of future sale and development of Outlots A or B, <br />a determination shall be made regarding the necessity of extending Michaud Way westerly as a <br />thru street to 20th Avenue North, if such extension is supported by a traffic study. If a traffic study <br />supports the need for the extension of Michaud Way, the extension, and all associated <br />modifications to the county road shall be required at no cost to the City. <br />B. TORRENS PROPERTY. <br />The City approved the Preliminary Plat subject to a condition that the Final Plat would only <br />contain land where Title was registered as Torrens property. At the time of Preliminary and Final <br />Plat approval, Block 1, Lot 1, was registered as a Torrens parcel and Block 1, Lot IA, was <br />Version 08/20/2021 for Council packet Page 16 <br />
