City of Centerville <br />Council Meeting Minutes <br />July 26, 2006 <br />Acting Mayor Lee indicated that Staff should investigate what other items are in that <br />easement and have them removed. <br /> <br />VIII. OLD BUSINESS <br /> <br />1. CSAH 14 Joint Powers Agreement <br /> <br />Council briefly discussed this item and agreed to add it to the work session Agenda for <br />August 2, 2006. <br /> <br />Mr. Francis Zimney of 7252 LaValle Drive indicated he has not seen the previous MOU <br />and he has had an issue relative to a design issue on this county road. He then said that <br />the issue he has had in front of them for two years is regarding a tiny retaining wall next <br />to his property and two weeks ago he got into negotiations regarding right of way and <br />was told if he wanted an answer on the retaining wall he should ask Lyndon Robjent, <br />which he did and got no response. <br /> <br />Mr. Zimney indicated that the design elements are County driven so his point is on item <br />12 it does say that any retaining walls and fences required due to trail someone should <br />pay for those and he feels it should be the County and he would like to know if it <br />becomes a City issue. <br /> <br />Mr. Zimney indicated the retaining wall would be 150 or more feet. <br /> <br />Mr. Zimney indicated that Item 9 the city is paying 100% of new concrete and or <br />bituminous for all upgraded driveways and he would be impacted by that as it is a private <br />road that they are proposing to blacktop 50 feet of that to pull the culvert and improve <br />drainage and he would be assessed if the City chose to pass that on. <br /> <br />Motion by Council Member Lakso, seconded by Council Member Paar to add this <br />item to the work session agenda. All in favor. Motion carried unanimously. <br /> <br />2. Proposed Ordinance #9 Second Series Amending Section 30.02 Relating to <br />Mayor and Council Compensation. <br /> <br />Motion by Council Member Lakso, seconded by Council Member Paar, to approve <br />Ordinance #9, Second Series Amending Section 30.02 Relating to Mayor and <br />Council Compensation. All in favor. Motion carried unanimously. <br /> <br />2A. Proposed Ordinance #XX, Second Series Amending Section 30.02 Relating to <br />Mayor and Council Duties <br /> <br />Motion by Council Member Lakso, seconded by Council Member Paar to table.
