The Developer warrants all Improvements required to be constructed by it pursuant to this Agreement against poor material and faulty workmanship. The warranty period for underground utilities is two years from the date of acceptance by the City. If all Improvements are installed by one contractor, the warranty period shall commence after the final wear course has been completed and the City has accepted the streets unless installation of the wear course has been delayed by the City, in which case the two-year period shall commence on the later of November 1, 2022, or the requested extension date requested by Developer pursuant to Section 9 herein. If streets and underground utilities are installed by separate contractors, the two (2) year warranty period on underground utilities shall commence following their completion and acceptance by the City. The Developer or his contractor shall post security in the amount of thirty- five percent (35%) of final construction costs to secure the warranties. The Developer or his contractor may use the existing Letter of CreditSecurity on file with the City, or a maintenance bond to satisfy this condition. The City standard specifications for utilities and street construction identify the procedures for final acceptance of streets and utilities. D. The Developer shall submit the Final Plat, construction plans plans in electronic format. The electronic format shall be either AutoCAD, .DWG file or a .DXF file using Anoka County coordinates. The Developer shall also submit two (2) complete sets of the final plat and construction plans on paper (22 x 34 or 24 x 36).
