Ord. #57, adopted 07/28/1993 <br />PROPERTY UNDER CONSTRUCTION <br />§ 150.45 SITE MAINTENANCE OF PROPERTY UNDER CONSTRUCTION. <br />(A) Containment of debris. On parcels on which construction is taking place, the property owner shall be <br />responsible to contain all rubbish, debris and excess construction material within the construction site. <br />(B) Removal of debris. <br />(1) The property owner is responsible to remove all rubbish, debris and excess construction material <br />from the construction site bi-weekly. <br /> <br />(2) In the event the property owner fails to contain or remove rubbish, debris or excess construction <br />material, the city shall be authorized to clean the premises and the property owner shall be <br />responsible for the costs thereof. <br /> <br />(C) Site maintenance deposit. <br /> <br />(1) A site maintenance deposit shall be placed in escrow to the city at the time that a building permit <br />is issued. The escrow charges shall be established according to the annual fee schedule approved <br />by City Council. <br /> <br />(2) Contingent upon no city action being required to monitor and/or clean the site, the escrow <br />amount as established per the annual fee schedule shall be refunded to the individual/company <br />that originally supplied the escrow deposit along with the building permit, less an administrative <br />fee also established per the annual fee schedule, at the time that construction on the parcel has <br />ceased, and the construction site is free of rubbish, debris and excess construction materials. <br /> <br />(D) Payment or assessment of costs. <br /> <br />(1) The cost for any action taken by the city to monitor or clean the site will be deducted from the <br />maintenance deposit. Should the costs for city action exceed the escrow deposit established by <br />the fee schedule, the property owner will be billed for the excess. <br /> <br />(2) A certificate of occupancy will not be issued for newly constructed buildings until this bill is <br />paid in full. <br /> <br />(3) Periodically, the Administrator shall list the total unpaid charges for monitoring and removal of <br />rubbish, debris or excess construction materials against each separate lot or parcel to which they <br />are attributable under this section. The City Council may then spread the assessment charges <br />against the property benefitted as a special assessment under M.S. § 429.101, as amended, and <br />other pertinent statutes for certification to the County Auditor and collection along with the <br />current taxes the following year. <br />260΋tğŭĻ <br /> <br />
