of the parcel into two or more lots or parcels, any one of which is less than five acres in <br />area or 300 feet in width; or <br /> <br />(f) Is a single parcel of residential or agricultural land of not less than 20 acres in area and <br />having a width of not less than 500 feet, and its conveyance does not result in the division <br />of the parcel into two or more lots or parcels, any one of which is less than 20 acres in <br />area or 500 feet in width. <br /> <br />(3) Exceptions. The following land divisions are exempted from the provisions of this division (E) <br />and upon request, the Administrator shall, within ten days, certify that this division (E)(3) does <br />not apply to these land divisions: <br />(a) Divisions of land where the division is to permit the adding of a parcel of land to an <br />abutting lot and the newly created property line will not cause the land or any structure to <br />be in violation of this chapter or the zoning chapter; and that the proposal would not have <br />an adverse impact on the subject property or surrounding properties; <br /> <br />(b) The division and addition of land will not be large enough to allow for the creation of an <br />additional lot for the purpose of building; or <br /> <br />(c) In the case of a request to divide a base lot upon which a 2-family dwelling, townhouse or <br />a quadraminium is located, which is a part of a recorded plat, where the division is to <br />permit individual private ownership of a single dwelling unit within the structure, and the <br />newly created property lines will not cause any of the unit lots or the structure to be in <br />violation of this chapter or the zoning chapter. If the Administrator makes a negative <br />determination and/or the applicant wishes to appeal the decision, the case shall be sent to <br />the Planning and Zoning Commission for recommendation to the City Council. <br /> <br />Ord. 2d 121, adopted 01/26/2022. <br />§ 153.16 EASEMENTS. <br /> <br />(A) Utility. Easements at least a total of 20 feet wide, centered on rear lot lines, shall be provided for <br />utilities where necessary. They shall have continuity of alignment from block to block, and at deflection <br />points, easements for pole line anchors shall be provided. <br /> <br />(B) Drainage. Where a subdivision is traversed by a watercourse, drainageway, channel or stream, there <br />shall be provided a stormwater easement or drainage right-of-way conforming substantially with the <br />lines of the watercourses, together with any further width or construction, or both, as will be adequate <br />for the stormwater drainage of the area.
