at an interest rate as the City Council shall determine. Unless deferred payment is so authorized, all <br />connection charges shall be payable in full prior to the issuance of a building permit for new <br />construction on the lot or tract of land. <br /> <br />(C) No permit shall be issued for any connection, repair, enlargement or alteration to the sewer system until <br />a determination has been made by the city of the service availability charge (SAC), to be imposed by the <br />Metropolitan Waste Control Commission, and the applicant has paid to the city the full amount of any <br />service availability charge that may be applicable. <br /> <br />Ord. #30, adopted 05/11/1977 <br /> <br />§ 51.08 MANDATORY CONNECTION TO PUBLIC SYSTEMS. <br /> <br />(A) It is unlawful for any person to install a private water system which is intended to provide water for <br />human consumption or a private sewer system in the city except in cases where the public water or <br />sewer systems are not accessible to the premises where the private systems are requested. To determine <br />whether or not the public water and/or sewer systems are available for connection, each person or <br />corporation desiring to install a private water or sewer system must first make application for connection <br />to a public system. Upon determination by the city that it is not feasible to connect the applicantÓs <br />premises to the public water or sewer system, then the applicant shall be granted a permit to install a <br />private water and/or sewer system in accordance with all appropriate state and local regulations and <br />subject to an agreement with the city recognizing the temporary nature of the private system. <br /> <br />(B) Notwithstanding the other provisions of this chapter, property served by a private water or private sewer <br />system shall immediately connect to public sewer and public water whenever a private sewer or private <br />water system fails, falls into disrepair, or creates a nuisance or health hazard. A system Ðfalls into <br />disrepairÑ when the costs of the repair exceeds $1,000.00. In any event, the necessity to bore a new or <br />replacement well is a condition which requires the property to connect to public water and public sewer. <br /> <br />(C) All property served by private sewer systems must connect to municipal sewer within 12 months of <br />when it is made available and if municipal sewer is available to properties not connected on the effective <br />date of this ordinance, the property must abandon the private system and connect to municipal sewer no <br />later than 12-31-2012. <br />(D) All property served by private water systems must connect to public water, if it is available, no later than <br />12-31-2017, except that where water is made available by the City after January 1, 2013, properties <br />served shall be connected no later than 12-31-2021. <br /> <br />Ord. 2d #26, amended 12/10/2008; Ord. 2d #38, amended 09/08/2010, Ord. 2d #62, amended 01/09/2013, <br />amended 05/22/2013. <br /> <br />§ 51.09 RULES AND REGULATIONS RELATING TO WATER SERVICE. <br /> <br />39 tğŭĻ <br /> <br />
