ENCROACHMENT AGREEMENT AGREEMENT ("Agreement") was made this � day of February, 2022 by and between the CITY OF CENTERVILLE, a Minnesota municipal corporation ("City"), and Kaitlyn Dukatz and Thomas M Dukatz, married to each other, a married couple ("Landowners"'). Landowners owner in fee as tenants to the real property situated in Anoka County, Minnesota, legally described as follows ("Subject Property"): PIN #14-31-22-42-4042 LOT 4, BLOCK 1 OLD MILL ESTATES 1841 Old Mill Court B. Landowners seek permission from the City to construct/locate a fence on the property lines (east side and rear yard) and the west fence being constructed from the edge of rear (southwest) corner of the home to connection/abutting to the neighbor's already constructed fence located on the property line which will encroach in the City's right-of-way/drainage and utility easement(s). NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS, THE PARTIES AGREE AS FOLLOWS: 1.
