Conditional Use Permit, or the Development Plans for the development ("Other Documents"), and <br />the Owner receives the Right To Proceed as set forth below, the Owner may record the Final Plat <br />and other land use documents with the County Recorder and/or the Registrar of Titles within one <br />hundred (100) days after approval of the Final Plat. If the Final Plat or other land use documents <br />are not recorded within the one hundred (100) days, the approval of the Final Plat or the Other <br />Documents is void, unless a written request for an extension is submitted to the City Administrator <br />before the one hundred (100) days expires. The extension will be approved or denied by the City <br />Council by placement on their agenda within fifteen (15) days of request for same. Such Final Plat <br />or Other Documents shall contain all landuse permissions, use permits, easements, and other forms <br />of permission and approvals as required for the construction and maintenance of improvements <br />for the development. <br />3. RIGHT TO PROCEED. Within the Land, the Owner may not grade (except as <br />authorized in a Permit issued by the City) or otherwise disturb the earth, remove trees, construct <br />sewer lines, water lines, streets, utilities, public or private improvements, or any buildings until all <br />the following conditions have been satisfied: 1) this Agreement has been fully executed or <br />consented to by all parties to this Agreement and filed with the City Administrator and recorded <br />against the Land, 2) the necessary Security (as defined in Section 19) has been received by the <br />City, 3) the Final Plat has been approved by the City Council and is in a form ready for recording <br />with the Anoka County Recorder's Office, 4) the necessary easements, rights -of -ways, covenants <br />or other land use documents have been recorded against the Land, and 5) the City Administrator <br />has issued a letter that all conditions have been satisfied and that the Owner may proceed (the <br />"Right to Proceed") - <br />DEVELOPMENT & SUBDIVISION AGREEMENT <br />CENTERVILLE AND AMAZON.COM <br />Draft Version 06/202I2022 A Page 3 <br />
