ENCROACHMENT AGREEMENT <br />AGREEMENT ("Agreement"} was made dais. day of July, 2022 by and between the CITY <br />OF CENTERVILLE, a Minnesota municipal corporation ("City"), and Mehan Bolton and Joshua <br />Spencer, single individuals living together ("Landowners"). <br />A. Landowner owners in fee as tenants to the real property situated in Anoka County, <br />Minnesota, legally described as follows (`.`Subject Property"): <br />PIN #23-31-22-11-0059 <br />7111 Brian Drive <br />LOT 9, BLOCK 1 <br />HARDWOOD POND ESTATES; SUBJ TO <br />EASE OF REC <br />B. Landowners seek permission to install a 6% wood privacy fence within the City's <br />drainage/utility easement as follows: commencing 10' back from the front fagade or the home <br />traveling south to the side property line encroaching the 20' easement by 10' feet, then running <br />westerly 78' parallel to the side property line encroaching the 50' easememt by 40', then <br />commencing northerly 84' along the rear property line connecting to the abutting property <br />owner's existing fence which is constructed directly on the property line which would encroach <br />the 5' easement by 5'. There will also be the same fencing material installed on the north side of <br />the garage approximately 22' hack from the front fagade running northerly to the side property <br />line 15' encroaching the 5' easement connecting to the abutting property owner's existing fence <br />which is constructed directly- on the property line which would encroach the easement by 5'. <br />1 <br />
