<br />Letter of Understanding <br />Page 2 <br />August 29, 2006 <br /> <br />Eligible Members <br />While interest is focused on Phase I, Phase II, mandatory and discretionary cities, all LMC <br />member cities may participate. Other regulated entities, i.e. interested watershed districts, may <br />participate for the purposes of receiving information and adding to the discussion, but will not <br />have formal standing in MCSC. <br /> <br />Legal Structure <br />Membership in the MCSC will become effective upon participating cities signing this Letter of <br />Understanding. It is understood that LMC will hire and supervise staff, retain necessary <br />consultants, provide fiscal and other general administrative support services. The LMC Board <br />has formal authority over the effort, but will appoint a nine-member Steering Committee to <br />provide direction and give recommendations. <br /> <br />Membership of Steering Committee <br />MCSC will work under direction of a nine member steering committee appointed by the LMC <br />Board of Directors. Members will serve three-year staggered terms, except to instigate the <br />staggered terms, initial steering committee members will each serve a one, two, or three year <br />term as determined by the LMC Board. The first year committee members will be: Lori Haak, <br />Water Resources Coordinator, Chanhassen (Chair); Jim Hafner, Stormwater Manager, Blaine; <br />Ross Bintner, Water Resources Engineer, Prior Lake; Bruce Westby, City Engineer, Monticello; <br />Bill Schluenz, Public Works Superintendent, Waite Park; Jeff Oliver, City Engineer, Golden <br />Valley; Terry Schultz, Director of Natural Resources, Burnsville; Andy Bradshaw, Civil <br />Engineer I, Moorhead; and Anne Weber, Civil Engineer, St. Paul. <br /> <br />Resources Provided <br />. MCSC participating cities will reimburse LMC for direct services and expenses such as <br />general administrative, Internet, and support staff services provided through LMC. <br />. MCSC participating cities will also reimburse LMC for the costs and expenses associated <br />with retaining the technical consultant for representation with regulatory agencies, member <br />advice, maintenance of guidance document, development of training, and input on <br />development of public educational materials <br /> <br />Maximum First Year Fee <br /> <br />The fee for the City of shall not exceed $ in <br />the first year of this agreement.
