(2) A customer may not be tattooed, pierced, branded or painted while under the influence of <br />alcoholic beverages or illicit drugs. <br />(L) Written instructions. The operator must provide the person tattooed, pierced or branded with printed <br />instruction on the approved care of the skin during the healing process. <br />(M) Living quarters. A place licensed as a tattoo, body piercing, body branding or body painting <br />establishment may not be used or occupied as living or sleeping quarters. <br />(N) Hepatitis. <br />(1) A person to be tattooed, branded or pierced must be asked whether the person has had viral <br />hepatitis in the preceding six months. <br /> <br />(2) A person suspected of presently having viral hepatitis or having had viral hepatitis within the <br />preceding six months may not be tattooed, branded or pierced unless the person has the written <br />consent of a licensed physician. <br />Penalty, see § 114.99 <br />Ord. #71, adopted 11/13/2002 <br />§ 114.11 REVOCATION, SUSPENSION OR NONRENEWAL OF LICENSE. <br /> The tattoo, body piercing, permanent cosmetic make-up, body branding and body painting license may <br />be revoked, suspended or not renewed by the City Council by showing that the licensee, its owners, managers, <br />employees, agents or any other interested parties, as enumerated in contents of the application for tattoo, body <br />piercing, permanent cosmetic make-up, body branding and body painting establishment license section of this <br />chapter with the exception of creditors have engaged in any of the following conduct: <br />(A) Fraud, deception or misrepresentation in connection with the securing of the license; <br />(B) Habitual drunkenness or intemperance in the use of drugs, including but not limited to the use of drugs, <br />defined in M.S. § 618.01, as amended, barbiturates, hallucinogenic drugs, amphetamines, Benzedrine, <br />Dexedrine or other sedatives, depressants, stimulants or tranquilizers; <br />(C) Failure to fully comply with any requirements of the city code regarding the sanitary and safety <br />conditions, zoning requirements, building code requirements or ordinances, the violation of which <br />involves moral turpitude, or failure to comply fully with any requirements of this chapter; or <br />(D) Engaging in any conduct which would constitute grounds for refusal to issue an establishment license. <br /> <br />Ord. #71, adopted 11/13/2002 <br /> <br />194tğŭĻ <br /> <br />
