§ 51.00 PURPOSE. <br />The purpose of this chapter is to establish minimum requirements for regulation and connection to the <br />public water and public sewer systems in order to protect public health and safety, groundwater quality and <br />prevent or eliminate the development of public nuisances. This chapter is intended to serve the best interests of <br />the CityÓs citizens by protecting its health, safety, general welfare, and natural resources. <br />Ord. 2d 91, amended 09/26/2018. <br />§ 51.01 DEFINITIONS. <br /> For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates <br />or requires a different meaning. <br />ACT. The Federal Water Pollution Control Act, also referred to as the Clean Water Act, as amended, 33 <br />U.S.C. §§ l25l et seq. <br />BEST MANAGEMENT PRACTICE OR BMP. Erosion and sediment control and water quality <br />management practices that are the most effective and practicable means of controlling, preventing, and <br />minimizing degradation of surface water, including construction-phasing, minimizing the length of time <br />soil areas are exposed, prohibitions, and other management practices published by state or designated <br />area-wide planning agencies. <br />COMPANY, GRANTEE and FRANCHISEE. Any public utility system to which a franchise has been <br />granted by the city. <br />CONSUMER and CUSTOMER. Any user of a utility. <br />DISCHARGE. Adding, introducing, releasing, leaking, spilling, casting, throwing, or emitting any <br />pollutant, or placing any pollutant in a location where it is likely to pollute public waters. <br />EPA. Environmental Protection Agency. <br />EROSION. The process by which ground surface is worn away by action of wind, water, ice, or gravity. <br />FALLS INTO DISREPAIR. Private water or private sewer Ðfalls into disrepairÑ when it fails, creates a <br />nuisance or health hazard, or the cost repair to same exceeds $1500.00. <br />GENERAL MUNICIPAL USER. Any user discharging sewage to the general municipal flow other <br />than industrial users, municipalities and other contract users. This category of user includes as sub- <br />categories: Domestic Users; Commercial Users; Institutional Users; and Governmental Users, which are <br />not contract users. <br />GROUNDWATER. Water contained below the surface of the earth in the saturated zone including, <br />without limitation, all waters whether under confined, unconfined, or perched conditions, in near surface <br />unconsolidated sediment or in rock formations deeper underground. <br />30 tğŭĻ <br /> <br />
