(A) It is unlawful for any person to install a private water system that is intended to provide water for <br />human consumption or a private sewer system for the sanitary removal of waste, in the city except in <br />cases where the public water or public sewer systems are not accessible to the premises where a <br />private system is requested. To determine whether public water or public sewer are available for <br />connection, each person or corporation desiring to install a private water or private sewer system must <br />first make application for connection to a public system. Upon determination by the city that it is not <br />feasible to connect the applicantÓs premises to public water or public sewer, then the applicant shall be <br />granted a permit to install a private water or private sewer system in accordance with all appropriate <br />state and local regulations and subject to an agreement with the city recognizing the temporary nature <br />of the private system. <br /> <br />(B) Notwithstanding the other provisions of this chapter, if a public service is available, property served by <br />a private water or private sewer system shall immediately connect to public water or public sewer <br />whenever a private sewer or private water connection falls into disrepair. <br /> <br />(C) All property served by private water or private sewer systems must connect to public water and public <br />sewer, if a public service is available to serve the property: 1) upon sale or transfer of ownership of a <br />parcel with a principal structure, or 2) upon expanding the structureÓs finished square footage by 33% <br />or more. <br /> <br />Ord. 2d 91, amended 09/26/2018. <br /> <br /> <br />§ 51.201 TRANSFER OF PROPERTIES. <br /> <br />(A) Whenever a conveyance of land occurs, the following requirements shall be met: <br /> <br />(1) The seller of the property is responsible for providing a completed City of Centerville point <br />of sale certificate, with any required attachments, to the buyer at or before closing. These <br />documents shall provide the status and location of all known private water or private sewer <br />connections and components thereof on the property and, if applicable, the requirements for <br />bringing the dwelling or other structure into compliance with this chapter; <br /> <br />(2) The buyer is responsible to file the City of Centerville point of sale certificate, and required <br />attachments, along with the certificate of real estate value at the County AuditorÓs Office; <br />and, <br /> <br />(3) If the seller fails to provide a certificate of compliance, sufficient security must be <br />established in the form of an escrow account to assure the installation of connections to <br />public water and public sewer. The security, in the amount set forth in the City of Centerville <br />Fee Schedule, shall be placed in an escrow with the City, a licensed real estate closer, <br />licensed attorney-at-law, or federal or state chartered financial institution. Connecting to <br />public water and public sewer must be installed within the time frame established in §§ <br />52.199. After connecting to public water and public sewer, and a certificate of compliance <br />issued, the escrow may be released. Escrow may be incrementally released to contractors if <br />approved by the city. <br />52 ΋tğŭĻ <br /> <br />
