ENCROACHMENT AGREEMENT <br />AGREEMENT (ÐAgreementÑ) was made this ____ day of July, 2022 by and between the CITY <br />OF CENTERVILLE, a Minnesota municipal corporation (ÐCityÑ), and Laura B. Grawe, Trustee <br />and Jared M Grawe, Trustee, a married couple, married to each other (ÐLandownersÑ). <br />RECITALS <br /> A. Landowner owners in fee as tenants to the real property situated in Anoka County, <br />Minnesota, legally described as follows (ÐSubject PropertyÑ): <br />PIN #26-31-22-22-0056 LOT 17, BLOCK 1 <br />7227 Clear Ridge LÓALLIER ESTATES PLAT 2, <br /> EX RD, SUBJ TO EASE OF REC <br /> <br />B. Landowners seek permission to install a raised garden within the CityÓs <br />drainage/utility easement in the front yard as follows: encroaching the CityÓs 10Ó easement by 8Ó <br />6Ñ with the front of the raised gardenÓs southeast corner, commencing through the easement to the <br />raised gardenÓs northeast corner encroaching the CityÓs 10Ó easement by 7Ó 4Ñ. The raised garden <br />will be installed north of the driveway located on the parcel. <br />NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS, <br />THE PARTIES AGREE AS FOLLOWS: <br />The City hereby grants Landowners permission to encroach into the CityÓs right-of-way/drainage <br />and utility easement(s) to the extent indicated on page one (1) of this agreement and the attached <br />EXHIBIT ÐAÑ. <br />1 <br /> <br />
