City of Centerville <br />Council Meeting Minutes <br />June 8, 2022 <br /> <br />Motion by Council Member Lakso, seconded by Council Member Mosher to Approve the <br />Purchase of the Toolcat in the amount of $77,202.49 as Presented. <br /> <br />Council Member Lakso stated that she liked the recommendation/suggestion from Council <br />Member Koski to include operating training and support. <br /> <br />Council Member Lakso added a friendly amendment to her motion. <br /> <br />Motion by Council Member Lakso to Approve the Purchase of a Toolcat in the amount of <br />$77,202.49 as presented with the inclusion of safety training and support. Council Member <br />Mosher accepted the friendly amendment. All in favor. Motion carried. <br /> <br />3. Resolution #22-0XX – Amazon Fulfillment Center <br /> a. Revised Developer’s Agreement <br />b. Maintenance Agreement between Rice Creek Watershed District and City <br /> <br />Attorney Glaser presented Council with several revisions to documents that were contained in their <br />packet. He stated that there were two (2) pieces to the presented resolution which were a <br />Maintenance Agreement between Rice Creek Watershed District and the City with regards to an <br />st <br />installed culvert by Amazon for drainage into Judicial Ditch 3 and 21 Avenue west ditch culvert <br />outlet and a revised Development & Subdivision Agreement for Fairview Second Addition which <br />contained revisions from previous Council meetings and negotiations with Amazon. <br /> <br />Attorney Glaser reviewed the revisions made to the Developer’s Agreement, ensuring Council that <br />their noise concerns were addressed and agreed to by Amazon. He stated that Amazon desired a <br />cap of $80,000 for noise mitigation if necessary and that they would pay for the agreed upon noise <br />study. <br /> <br />Lengthy discussion was had regarding noise, indemnification/hold harmless language, language <br />contained regarding the construction of private utilities (sewer/water/storm water) within the <br />City’s right of way and responsibility for maintaining them, shut off valves, sewer protections, <br />securement of an easement for the installation of the culvert, etc. <br /> <br />Motion by Council Member Lakso, seconded by Council Member King to Approve Res. #22- <br />016 as Presented. Mayor Love, Council Members Koski, Lakso and King – Aye, Council <br />Member Mosher - Nay. Motion carried. (4/1). <br /> <br />4. Resolution #22-0XX – Ordering the Feasibility Report for the 2022 Thin Overlay <br />and City Hall Parking Lot Improvements <br /> <br />Administrator Statz stated that this was a formality that we authorized the engineer proposal at the <br />last meeting for the Feasibility Study. He stated that a formal resolution authorizing the <br />preparation ordering the Feasibility Report was missed and needed to be contained due to the 429 <br />process. He stated that Stantec will appear at the next meeting with that report. <br /> <br />Discussion ensued regarding the Thin Overlay and its assessment versus not assessing the parking <br />lot improvements, explanation of a feasibility report and why it is required as part of the 429 <br />Page 4 of 9 <br /> <br /> <br />
