§ 111.22 PROHIBITED CONDITIONS. <br />(A) Prostitution. No licensee shall knowingly permit the licensed premises or any room in those premises or <br />any adjoining building directly under the licenseeÓs control to be used by prostitutes. <br /> <br />(B) Controlled substances. No licensee shall knowingly permit the sale, possession or consumption of <br />controlled substances on the licensed premises in violation of state law. <br /> <br />(C) Gambling. <br /> <br />(1) Gambling and gambling devices, with the exception of licensed charitable gambling <br />organizations, are not permitted on licensed premises. <br /> <br />(2) State lottery tickets may be purchased and sold within licensed premises as authorized by the <br />Director of the State Lottery. <br /> <br />(C) Contests of pugilism on the premise of licensed establishments is prohibited. <br /> <br />(1) The City Council finds that it is in the best interests of public health, safety and general welfare <br />of the people of the city that Boxing, Ultimate Fighting or more generally, contests involving <br />pugilism or battery are prohibited as provided in this section on the premises of any <br />establishment licensed under this chapter. This is to protect and assist the owner, operators and <br />employees of the establishment, as well as patrons and the public in general, from harm <br />stemming from the physical immediacy and combination of alcohol and violence. The Council <br />especially intends to prevent any endorsement of assaultive behavior or activities likely to lead to <br />the possibility of various criminal conduct, including assault, battery, threatening behavior, <br />disorderly conduct, or public nuisance. The Council also finds that the prohibition of contests <br />involving pugilism or battery on the premises of any establishment licensed under this chapter, <br />as set forth in this section, reflects the prevailing community standards of the city. <br /> <br />(2) The City Council finds that it is in the best interests of enforcing its Liquor Regulations and <br />policing establishments which can serve intoxicating beverages that the previous Subdivision <br />shall also apply to non-alcoholic events on the licensed premises. <br /> <br />(3) A violation of this section is a misdemeanor punishable as provided by law, and is justification <br />for revocation or suspension of any liquor, wine, or 3.2 percent malt liquor license or the <br />imposition of a civil penalty under the provisions of this chapter. <br /> <br />Ord. #13, adopted 08/28/2002 <br /> <br />§ 111.23 INACTIVE LICENSE. <br /> <br />164|Page <br /> <br />
