CFD 2023 Budget <br /> <br />Motion by Council Member Koski, seconded by Council Member Mosher to Approve the Consent <br />Agenda Items #1-7. All in favor. Motion carried. <br /> <br />Item #8 Î Administrator Statz stated that staff attempted to secure three (3) proposals but only two (2) <br />were received and that the selected contractor and staff had difficulty with contract language. Attorney <br />Glaser reviewed the contact with the selected contractor and had concerns with language associated with <br />a limitation of liability clause which he believes that the CityÓs exposure is limited and Braun has <br />unlocked that limit with a normal contract and up to our insurance liability and give us a workmanship <br />warranty different than the contract before you this evening. Administrator Statz stated that staff has <br />recommended Braun Intertec for the 2022 Thin Overlay Project. He explained that even though BraunÓs <br />proposal was higher than the other bidder, they have an industry reputation and extensive experience in <br />in this type of work. <br /> <br />Attorney Glaser stated that Council could consider the contract allowing him to draft appropriate <br />language limiting the cityÓs liability and providing a workmanship warrant from the contractor similarly <br />to the way Council has authorized him to draft revisions to other contracts without them see it or the <br />contract could come back to Council with the revisions at their next meet. He did state that Administrator <br />Statz would desire the contract to be approved provisionally with the AttorneyÓs language as Bituminous <br />Roadways anticipated starting paving the following day and that the contact was needed as soon as <br />possible. <br /> <br />Motion by Council Member Koski, seconded by Council Member Mosher to Approve the Materials <br />Testing Contract with Braun Intertec Contingent upon the City AttorneyÓs Approval. All in favor. <br />Motion carried. <br /> <br />Item #9 & 10 Î Administrator Statz stated that the budgets were not contained in the Council packets. <br />He stated that the Joint Powers Agreements stated that each member city must adopt individually even <br />though the Fire Steering and Governing Board have already approved. He reported that he felt that the <br />Council should approve them prior to the CityÓs budget. He stated that the final budget numbers are <br />within $1,000 of what has been discussed previously. He also reported that the Centennial Lakes Police <br />budget being $3,110,855 with the CityÓs portion increasing $44,567 from the previous year and the <br />Centennial Fire District budget being 705,309 with the CityÓs portion increasing $23,093 from the <br />previous year. <br /> <br />Motion by Council Member Koski, seconded by Council Member Mosher to Approve Items #9 & <br />10 as presented.
