CITY OF CENTERVILLE REQUEST FOR COUNCIL ACTION Agenda Item # Department: Requested Council Meeting Date: January 25, 2023 Engineering VIII.1 TITLE OF ISSUE: Vacation of Easement at 1844 Old Mill Court BACKGROUND AND SUPPLEMENTAL INFORMATION: After much discussion and the exploration of many options, the homeowner at 1844 Old Mill Court elected to move the retaining wall on his property to the east about 4 to 5 feet in an effort to move the development's trail to the east, further from the home. With this move, it is appropriate for the easement to be moved as well. The attached easement document shows both the existing and proposed easements. The Planning Commission held a public hearing and is recommending approval of the vacation of the existing easement in lieu of a new, recorded easement. COST AND SOURCE(S) OF FUNDING: No cost to city. All costs of moving the wall and recording the easement have and will be paid by the owner. REQUESTED COUNCIL ACTION: Motion to approve the vacation of the trail easement on 1844 Old Mill Court, contingent upon the recording of a new easement, both as described on the attached.
