Date: June 6, 2022 <br />To: Planning & Zoning Commissioners <br />From: Athanasia Lewis, Assistant City Administrator <br />Subject: Request for Shed Variance at 1746 Dupre Rd <br />The Staff has received a request for a variance for reconstruction of a shed, at 1746 Dupre Rd, to <br />replace a twenty-year old shed that no longer meetings the needs of the resident. The reconstructed <br />shed would be two feet longer and two feet deeper than the existing shed. <br />The applicant states that the existing shed is no longer functional and that a reconstructed shed <br />would be more functional. The applicant also indicates that the new shed would not impact the <br />surrounding properties or the character of the neighborhood. <br />Staff Recommendation <br />Approve the request for a variance for reconstruction of a new shed at 1746 Dupre Road with the <br />following findings: <br />(1)The property owner proposesto use the property in a reasonable mannerby an official <br />control: The applicant plans to use the rebuilt shed for storage, in the same way the existing <br />accessory structure is being used. The City Code does not allow for sheds in any yard <br />except the rear yard. Since this lot has a small and heavily wooded rear yard, while it has <br />a large, vacant side yard, it is reasonable to use the side yard for a shed. <br />(2)The plight of the landowner is due to circumstances unique to the property not created by <br />the landowner;and the variance, if granted. The landownerÓs lot is pie-shaped, which <br />causes certain issues for placement of accessory structures. The owner did not create the <br />shape or topography of his lot. <br />(3)The variance will not alter the essential character of the locality. The reconstructed shed <br />will be placed in the side yard, in roughly the same location as the existing shed. Given the <br />large area of the side yard, the placement of the shed near the rear of the side yard, a <br />significant distance from the street and the size of the proposed shed, its presence will not <br />alter the essential character of the neighborhood. <br />(4)Economic considerations alone do not constitute practical difficulties.
