CITY OF CENTERVILLE <br />REQUEST FOR <br />COUNCIL ACTION <br />CVL,e teryi(fe <br />Esta6Cished 1857 <br />Agenda Item # <br />Department: <br />Requested Council Meeting Date: <br />IX.2 <br />Administration - City Clerk <br />May 24, 2023 <br />TITLE OF ISSUE: <br />Stormwater Utility Cost Share - Oak Circle Project & Special Assessment Agreement/Waiver <br />BACKGROUND AND SUPPLEMENTAL INFORMATION: <br />In 2013 the city put into place Res. 913-022 - Authorizing City Participation in Resolving Private Storm Drainage Problems, which would allow property owners an <br />opportunity to cost share with the city (25%) and have the ability to have the remainder placed on their property taxes through special assessments (75%). The <br />resolution references "groups of property owners" as several residents had addressed Council regarding wet backyards. The project involved numerous residents and <br />not all of them wanted to participate in the program. At that time, the intent was to have 100% participation if a project were to occur and impact a group. However, <br />over time, larger projects have not been posed to the City until recently -- we have received two requests from an individual property owner and two abutting property <br />owners. Minutes are attached from the October 9, 2013 meeting for your reference. <br />Mr. & Mrs. Alexander Haffke have approached the City for work to be completed in their backyard with connection into the city's infrastructure (catch basin in a <br />drainage/utility easement) located behind their home. They have signed a Special Assessment Agreement & Waiver of Appeal and agreed to grant the city an <br />easement for maintaining the installed 60' draintile/pipe and catch basin drafted by the Clerk and reviewed by the City Attorney. <br />Additional areas of concern with language contained in the resolution are the length of time that the assessment should run and interest rate.
