ENCROACHMENT AGREEMENT <br />AGREEMENT ("Agreement") was made this th day of July, 2023 by and between the CITY <br />OF CENTERVILLE, a Minnesota municipal corporation ("City"), and Jessica Rae McCollor and <br />Derek Allen McCollor, a married couple ("Landowners"). <br />RECITALS <br />A. Landowners owner in fee as tenants the real property situated in Anoka County, <br />Minnesota, legally described as follows ("Subject Property"): <br />PIN #14-31-22-43-0065 LOT 5, BLOCK 1 <br />1846 — 73RD STREET ACORN CREEK <br />B. Landowners desires to construct a 4' chain link fence within the side yard setback <br />within the city's right-of-way/drainage and utility easements on the east side of the property. <br />Landowners seek permission from the City to encroach in the City's right-of-way/drainage and <br />utility easements as follows: commencing from the rear fagade of the home, heading east 30' to <br />the property line, encroaching the right-of-way/drainage and utility easement by 10' and then <br />heading southerly approximately 38' encroaching in that same easement by the 10' along the <br />property line to connection to an existing fence on the property. <br />NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL COVENANTS, <br />THE PARTIES AGREE AS FOLLOWS: <br />1 <br />
