The determination of land use shall be by its zoning designation. <br />(3) Sounds exempt from noise level requirements. Sounds emanating from the operation of motor <br />vehicles on public highways, aircraft and outdoor implements such as power lawnmowers, snow <br />blowers, power hedge clippers, power saws, pile drivers, jackhammers and other construction <br />equipment are exempt from the sound level requirements but shall observe the time restriction <br />provisions of this division. <br />(4) Exceptions for special events. The City Council shall have the authority, consistent with this <br />section, to grant exceptions from the requirements of any division of this section for special <br />events. Any person seeking an exception shall file an application at City Hall with the <br />Administrator or his or her designee on a form prescribed by the city. The application shall state <br />the dates during which the application is proposed, the location of the noise source and time of <br />operation, the nature of the noise source, reasons why the exception is sought, steps taken to <br />minimize the noise level and other information as is required by the city. <br />(a) The city shall, within 30 days from the receipt of the application, approve or deny the <br />application. The application will be presented to the City Council for consideration and <br />may be approved only if the City Council finds that full compliance with the <br />requirements of this section would constitute an unreasonable hardship on the applicant, <br />on other persons or on the community.
