(1) Any place or area where law enforcement has determined that conditions associated with the <br />operation of an unlawful clandestine drug lab exist. <br />(2) A CLANDESTINE DRUG LAB SITE may include dwellings, accessory buildings, accessory <br />structures, a chemical dumpsite, any land or personal property which may include vehicle(s), <br />boat(s), trailer(s) and the like. <br />(3) WASTES generated from a clandestine drug lab shall be treated, stored, transported or disposed <br />of in a manner consistent with Minnesota Department of Health, Minnesota Pollution Control <br />and Anoka County Health Department rules and regulations. <br />CONTROLLED SUBSTANCE. Any drug, substance or immediate precursor in M.S. § 152.02 <br />Schedules I through V, as amended, together with any amendments or modifications thereto. The term <br />shall not include distilled spirits, wine, malt beverages, intoxicating liquors or tobacco. <br />MANUFACTURE (in places other than a pharmacy). Means and includes the production, cultivation, <br />quality control and standardization, by mechanical, physical, chemical or pharmaceutical means, and the <br />packing, repacking, tableting, encapsulating, labeling, relabeling or filling or by other process of drugs. <br />OWNER. Any person(s), firm(s), corporation(s) or other entity who or which owns, in whole or in part, <br />the land, building, structure, vehicle, boat, trailer or other location associated with a clandestine drug lab <br />site or chemical dump site. <br />PUBLIC HEALTH NUISANCE. All dwellings, accessory structures and buildings or adjacent <br />property associated with a clandestine drug lab site are potentially unsafe due to health hazards and are <br />considered a public health nuisance pursuant to M.S. §§ 463.15 et seq.; 463.15 et seq.; 412.221 et seq.; <br />and 145A.01 et seq., as they may be amended from time to time. <br />Ord. #77, adopted 1211012003 <br />§ 91.47 DECLARATION AS PUBLIC HEALTH NUISANCE. <br />All dwellings, accessory structures, buildings, vehicles, boats, trailers, personal property, adjacent <br />property or other locations associated with a clandestine drug lab site or chemical dump site are potentially <br />unsafe due to health hazards and are hereby declared to be a public health nuisance pursuant to M.S. §§ 463.15 <br />et seq.; 463.15 et seq.; 412.221 et seq.; and 145A.01 et seq., as they may be amended from time to time. <br />Penalty, see § 91.99 <br />Ord. #77, adopted 12/10/2003 <br />§ 91.48 LAW ENFORCEMENT ACTION. <br />(A)If law enforcement authorities determine the existence of a clandestine drug lab site or chemical dump <br />site, the site and all personal property therein shall be declared a public health nuisance. <br />1021 Page <br />
