(6) The City Fire Department; <br />(7) The appropriate enforcement division of the Drug Enforcement Administration of the U.S. <br />Justice Department; and <br />(8) Other city, state and local authorities, such as the City Water Department, the Minnesota <br />Pollution Control Agency, the Department of Natural Resources and any other agency or <br />authority which is known to have public and protection responsibilities that are applicable to the <br />situation. <br />(D)Modification or removal of declaration. The City Building Official or designee is authorized to modify <br />or remove the declaration of public health nuisance after the Building Official or designee receives <br />documentation from a city -approved environmental hazard testing and cleaning firm, stating that the <br />suspected health and safety risks, including those of neighbors and potential dwelling occupants, either <br />do not exist or have been sufficiently abated or corrected to justify amendment or removal of the <br />declaration. <br />Ord. #77, adopted 1211012003 <br />§ 91.51 SITE OWNER'S RESPONSIBILITY TO ACT. <br />(A) Within ten business days of the date the abatement order is mailed to the owner of the site, the owner <br />shall accomplish the following: <br />(1) Provide the City Building Official or designee, City Administrator and City Attorney with <br />written notification: <br />(a) That the owner has confirmed that all persons and their pets have vacated the site; <br />(b) Of the name(s) of all children who the owner believes were residing at the site during the <br />time period the clandestine drug lab or chemical dump site is suspected to have been at <br />the site; and <br />(c) That the site will remain vacated and secured until the public health nuisance is <br />completely abated as required by this subchapter. <br />(2) Contract with one or more city -approved environmental hazard testing and cleaning firms to <br />conduct the following work in accordance with the most current Minnesota Department of <br />Health guidelines: <br />(a) A detailed on -site assessment of the extent of contamination at the site and the <br />contamination of the personal property therein; <br />105 1 Page <br />
