(1) A city -approved environmental hazard testing and cleaning firm has advised the city, in writing, <br />that the item(s) of personal property can be sufficiently cleaned to remove all harmful <br />contamination; and <br />(2) The owner of the personal property agrees in writing: <br />(a) That the owner is aware of the danger of using the contaminated property; <br />(b) That the owner will thoroughly clean the property to remove all contamination prior to <br />the use of the property; and <br />(c) That the owner releases and agrees to indemnify the city, its staff and the City Council <br />from all liability to the owner and/or third persons for injuries or damages caused, or <br />alleged to have been caused, by the contaminated property <br />Ord. 977, adopted 1211012003 <br />§ 91.60 CITY COUNCIL REVIEW/RIGHT TO APPEAL. <br />The owner of the property or any party with a legal interest in the property who has been issued a <br />declaration of public health nuisance, an order for abatement, or a statement of public costs may appeal to the <br />City Council. The appeal shall be in writing, filed with the Administrator and Anoka County Community <br />Health and Environmental Services, specifying the grounds for the appeal and the relief requested. The appeal <br />must be filed within ten days of the issuance of the item from which appeal is taken. The City Council shall <br />hear the appeal at the next available City Council meeting. Upon review, the City Council may affirm, modify <br />or reverse the action taken. The filing of an appeal shall suspend the terms of the declaration of public health <br />nuisance, order for abatement or statement of public costs, whichever is applicable. However, in the instance of <br />an appeal from an order for abatement, the appeal shall not suspend that part of the order prohibiting occupancy <br />of the property. <br />Ord. 977, adopted 1211012003 <br />§ 91.99 PENALTY. <br />Any person violating any of the provisions of this chapter shall be guilty of a misdemeanor. <br />1101 Page <br />
