Res. #23 -0XX <br />A RESOLUTION AUTHORIZING CITY PARTICIPATION IN RESOLVING <br />PRIVATE STORM DRAINAGE PROBLEMS <br />WHEREAS, there are a number of areas in the city where grades are inadequate to properly drain <br />residential properties resulting in standing water and unusable yards, and <br />WHEREAS, the drainage problems are usually through no fault of the property owners, <br />and <br />WHEREAS, some of these circumstances can be alleviated through installation of drain tile <br />systems or other drainage facilities installed in the drainage easements that exist on the property, <br />and <br /> <br />WHEREAS, these problems often affect numerous properties and cannot be effectively resolved <br />by any one property owner, and <br />WHEREAS, even though these problems are often cosmetic and do not present a danger of <br />property damage through flooding, the public good may be served by removing standing water <br />and the associated nuisances. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF CENTERVILLE, <br />MINNESOTA: <br />1) The Council authorizes staff to work with individual or groups of property owners to resolve <br />the private drainage issues where it is possible to do so by constructing drainage facilities in public <br />easements and where it is impossible to correct these issues without constructing improvements or <br />connecting to improvements on another property. Where improvements are made outside of <br />existing easements, on properties receiving cost participation from the city, an easement <br />encompassing the improvements must be granted to the city, without compensation. <br />2) The council authorizes participation in the cost of these structures improvements by sharing in <br />25% of the cost of the project to be paid from the Stormwater Fund, provided the property owners <br />agree to voluntarily be assessed or post a cash security for the remaining 75% of the cost, and <br />further provided that the maximum city -share participation in these kinds of projects is limited to <br />$5,000 per property on which improvements are made and may be limited to $210,000 in any <br />calendar year and or any lower amount as fund availability may dictate. aA portion of the fund's <br />budget shall be reserved for this purpose. <br />3) The City Council hereby authorizes financing of the property owner share through voluntary <br />special assessment agreements, such financing for a maximum of five years at 4.5% an interest <br />rate to be set by the City Council at the date of approval for each application. <br />4) Applicants for this cost participation must solicit a minimum of two bids. The applicants may <br />use either bid, but the cityÓs cost participation and allowable assessment amount will be based on <br /> <br />
