<br />157.09. Industrial Sites. <br />Certain industrial sites are required to prepare and implement a stormwater pollution prevention plan, and shall <br />file a notice of intent (NOI) under the provisions of the National Pollutant Discharge Elimination System <br />(NPDES) general permit. The stormwater pollution prevention plan requirement applies to both existing and <br />new industrial sites. <br /> <br />157.10. Wetlands. <br />Runoff shall not be routed directly to wetlands without first passing through an appropriate settling or approved <br />pre-treatment basin. Said basins must meet engineering standards for volume and flow directed to the basin. <br />(A) A protective buffer strip of natural vegetation at least 15 feet (25 feet is preferred) <br />in width shall surround all wetlands. <br />(B) Wetlands must not be drained, filled, or altered, wholly or partially, unless in <br />compliance with and permitted under the most current rules adopted by the <br />Minnesota Board of Water and Soil Resources in the Wetland Conservation Act <br /> (WCA). Wetland replacement must be guided by the following principles in <br />descending order: <br />(1) Avoidance <br />(2) Minimization <br />(3) Mitigation <br />(C) Permits to work in wetlands must be obtained from the local water management <br />organizations, acting as local governmental units (LGU), with respective jurisdiction within the City to <br />administer the WCA. <br />(D) Permanent boundary markers, in the form of signage approved by the City, should be installed prior to <br />final approval of the required clearing and grading plan. <br /> <br />157.11. Maintenance of Stormwater BMPÓs. <br />(A) The design and planning of all stormwater management facilities shall include detailed maintenance <br />and repair procedures to ensure their continued function. These plans will identify the parts or components of a <br />stormwater management facility that need to be maintained and the equipment and skills or training necessary. <br />Provisions for the periodic review and evaluation of the effectiveness of the maintenance program and the need <br />for revisions or additional maintenance procedures shall be included in the plan. <br />(B) All private stormwater BMPs shall be maintained by the owner(s) such that the BMP performs the <br />intended treatment function. Public stormwater BMPs shall be the responsibility of the City in that the City will <br />ensure that the capacity of retention/detention ponds is adequate and will repair or replace storm sewer system <br />components as needed. <br />(C) The applicant must ensure access to all stormwater treatment practices at the site for the purpose of <br />inspection and repair by securing all the maintenance easements needed on a permanent basis. These easements <br />will be recorded with the plan and will remain in effect even with transfer of title to the property. <br />(D) The applicant must execute an easement and an inspection and maintenance agreement binding on all <br />subsequent owners of land served by any on-site stormwater management measure in accordance with the <br />specifications of this ordinance. <br /> <br />157.12-157.14 Reserved <br /> <br />157.15.
