RESOLUTION #24-XXX <br /> <br />CITY OF CENTERVILLE <br />RESOLUTION APPROVING CENTER MARKET <br />TOBACCO SALE VIOLATION PENALTY <br /> <br />WHEREAS, Center Market, located at 1801 Main Street in the City of Centerville, holds a license for <br />the sale of tobacco products; and <br /> <br />WHEREAS, on November 10, 2023, Center Market failed a compliance check when its licensee sold <br />tobacco products to an underage decoy; and <br /> <br />MOREOVER, this is the first tobacco sale license violation of the business; and <br /> <br />WHEREAS, pursuant to Centerville Code of Ordinances §116.99(a), any licensee found to have <br />violated the tobacco sale license regulations shall be charged an administrative fine which shall be <br />determined by resolution of the City Council for a first violation; and <br /> <br />WHEREAS, the City of Centerville 2024 Fee Schedule authorizes a fine in the amount of $250 for a <br />first tobacco sale license violation; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />CENTERVILLE, MINNESOTA AS FOLLOWS: <br />1. Center Market is hereby found to have violated the tobacco sale license regulations of <br />Centerville Code of Ordinances Chapter 116, and is hereby directed to pay a fine in the amount <br />of $250 for the violation. <br />2.
