Memorandum <br />Date: August 30, 2024 <br />To: Honorable Chair and Planning Commission <br />From: Mark Statz, PE – City Administrator/Engineer <br /> <br />Subject:Concept Sketch Review –Iron Valley Equipment <br /> <br /> <br />Staff has received a concept sketch from Iron Valley Equipment to occupy an existing <br />th <br />building and site on 20 Avenuein the B-1 Commercial zoning district. Attached to this <br />memo is a letter sent by city staff to theprospective lease holder regarding the viability of <br />his proposed business within the zoning code and with deference to additional rights <br />afforded the property through existing <br />Conditional Use Permits (CUPs) and <br />continuous occupation(grandfathering). <br />The letter explains that the existing site <br />(not just the current lessee)is subject to <br />two separate CUPs, both for an “Auto <br />Repair Business" <br /> <br />Conditional Use Permits <br />The existing Conditional Use permits for <br />an “Auto Repair Business”does not line <br />up explicitly with language in our Table <br />of Allowed Uses. However, the <br />description certainly fits as a same or similar match to “Automobile and Motorized <br />Equipment Service, Excluding Salvage Operations”, as is listed in our table. <br /> <br />The proposed user (Iron Valley Equip.) has an operation which will perform some tasks <br />akin to “Service”. Their business includes installing accessories and making repairs to <br />accessories or modifying vehicles to accommodate accessories, such as plows, dump <br />boxes, lights, etc. However, much of their business also includes the sale of these same <br />products. This means their “use” under the zoning code might be a mixture of both sales <br />and service. <br /> <br /> <br />
