Summary <br />The city’s Planning and Zoning Commission acts as the “Board of Appeals and <br />Adjustments”. However, city code also specifies that the commission only recommends <br />approval or denial of the application, with a final decision to be made by the City <br />Council. <br />Therefore, the Planning Commission should examine the application, hold a public <br />hearing and make a recommendation to the City Council for approval or denial. <br />Recommendations <br />Staff’s recommendation is for approval of the application for a variance with the <br />following findings and conditions: <br />Findings of Fact <br />The home originally sat on a larger parcel and had a different driveway <br />configuration, as there was no nearby public street. <br /> When the new LaValle Drive was constructed, it created a disconnected portion <br />of the driveway leading to the rear tuck-under garage. <br /> The disconnected remnant driveway creates a practical difficulty, which is not a <br />product of the owners’ actions or proposed improvements. <br /> It is reasonable for the homeowner to utilize the rear tuck-under garage for the <br />storage of vehicles or other trailered equipment. <br /> The home is uniquely positioned on the lot due to the alignment of the new, <br />LaValle Drive. <br />The variance would only result in a small section of pavement and would not alter <br />the essential character of the neighborhood. <br /> The variance would allow access to the tuck-under garage without driving on the <br />grass. <br /> <br />Conditions <br /> The driveway extension shall be no wider than the existing remnant driveway. <br />The driveway extension shall be paved. <br />Prior to installation, a driveway permit shall be obtained. <br />If the home is remodeled in such a way as to eliminate the rear tuck-under garage, <br />the driveway shall be removed, and the variance shall expire. <br /> <br /> <br /> <br />
