Earned Sick and Safe Time <br />There is some confusion caused by the wording we adopted regarding ESST in 2023. It <br />was not our intention to provide leave time to temporary employees such as election <br />judges and others who are not anticipated to work at least 80 hours in the year, but that <br />seems to be the result of our policy language. <br />To clarify, we are asking the City Council to amend the policy to read: <br />Accrual for Part-time and Seasonal Employees: <br />Part-time and seasonal employees will accrue PTO/ESST at a rate of .0333 per hour <br />or 1 hour per 30 hours worked <br />PTO/ESST will be paid at the same hourly rate an employee earns when they are <br />working and paid at least the state minimum wage. Paid PTO/ESST hours will not <br />count as hours worked for the purposes of overtime calculation. No ESST is given <br />to Election Judges and other temporary employees unless they work 80 hours or <br />more during the calendar year. <br />Summary <br />With these two changes, staff believes our Personnel Policy is ready for the next year. We <br />still have the challenge of the State of Minnesota Paid Family and Medical Leave, but there <br />is not enough guidance currently available to be able to determine how we should respond. <br />This program does not apply until 2026, so there is sufficient time available to craft a policy <br />and implement it prior to the effective date. <br />Staff is recommending that the City Council adopt the attached resolution to amend the <br />Personnel Policy. <br />
