When considering a rezoning request, the Planning Commission and City Council are <br />acting in a legislative capacity, meaning they may choose to allowthe change or not, <br />based solely on whether or not the proposed changeseems to be a good thing for the <br />city’s overall development plan. <br />Rezoning <br />If the Comprehensive Plan Amendment is approved, the consideration of the rezoning <br />request must be done with the Planning Commission andCity Council acting in a quasi- <br />judicial role. In rough terms, if the CompPlan is changed to Public/Semi Public <br />guidance for this property, thecity wouldlikely be compelled to approve a rezoning <br />request. The applicant has requested that the rezoning immediately follow the acceptance <br />of this Comp Plan Amendment. <br />Current Zoning <br />Thecurrent zoning of the property as M-2 Mixed Use Neighborhood allows for the <br />construction of a public buildingunder a Planned Unit Development (PUD). <br />While the city may have the prerogativeto deny the Comprehensive Plan Amendment, <br />the fact that a proposedpublic building is allowed in theMixed Use Zoning District may <br />render that point moot. It’s likely that if an application to develop the property with a <br />schoolbuilding came forward, thecity wouldneed to allow it under the current code. <br />However, leaving the zoning as-is may lead to a building which straddles a property line <br />andresides in two separatezoning districts, makingfor a messy set of rules to govern the <br />property. <br />Conclusions and Recommendations <br />Clearly, ensuring there is an elementary school in Centerville for the foreseeable future is <br />an important part of maintaining the city’s small town feel. Proximity to good schools is <br />always a top reason people site when asked why they chose to live someplace.With that <br />in mindthe city should becommitted to the success of the elementary school and doing <br />what it can to be certain that the current site can meetfuture needs. <br />Staff is recommendingapproval of the Comprehensive Plan Amendment and Rezoning <br />Application with thefollowing Findings: <br />1.Thesite is currently guided for Central Business District/Mixed Use and zoned <br />for M-2 Mixed Use Neighborhood. <br />2.Public Buildings are an allowed in the current zoning district and the proposed <br />zoning district. <br />3.Guiding the land for Public/Semi Public in the City’s Comprehensive Plan is a <br />more transparent way to plan for the future expansion of the school. <br /> <br />
