TO: Planning & Zoning Commission <br />FROM: Kurt Glaser, City Attorney <br />DATE: 11/07/2024 <br />RE: Public Hearing re: Retail Cannabis Business Operations <br /> <br />Summary of Ordinance No. 24-xx: Regulation of Adult-Use Cannabis in Centerville <br />The draft ordinance establishes a framework for the licensing, registration, and regulation of <br />adult-use cannabis businesses within Centerville. Here is a summary of the ordinance. In <br />addition to the adoption of this Ordinance, zoning text amendments will also be necessary to <br />establish locations within the City where Cannabis Retail Businesses may be located. <br />1. Purpose and Scope <br /> The ordinance outlines requirements for cannabis businesses to legally operate in Centerville. <br />It aligns with state laws to ensure responsible integration of adult-use cannabis retail in the <br />community, prioritizing public health and safety. <br /> <br />2. Definitions <br /> The ordinance specifies terminology relevant to cannabis regulation, such as "Adult-Use <br />Cannabis Product" (cannabis products approved for non-medical adult use) and "Cannabis Retail <br />Business" (businesses registered with the city to sell adult-use cannabis). This section clarifies <br />distinctions between different product types, such as adult-use, medical, and hemp-derived <br />products. The ÐCannabis Retail BusinessÑ definition is a more restrictive definition than that <br />found in Minnesota Statutes to narrow the types of cannabis businesses that would be allowed in <br />the City. <br />3. Licensing and Registration Requirements <br /> - State License Requirement: All cannabis retailers must first secure a license from the <br />Minnesota Office of Cannabis Management (OCM). <br /> - City Registration Requirement: Before beginning sales, licensed retailers must register with <br />the city and pay a registration fee. Registrations are non-transferable and must be renewed <br />annually, with fees set by the cityÓs Master Fee Schedule, subject to limitations as set forth in <br />Minnesota Statutes. <br /> - Limit on Retail Licenses: Private cannabis retail licenses available in the City are capped at <br />one for every 12,500 residents to prevent market saturation.
