CITY OF CENTERVILLE REQUEST FOR COUNCIL ACTION Agenda Item # Department: Requested Council Meeting Date: December 11, 2024 Legal IX.5.b TITLE OF ISSUE: Tobacco License Violation - Centerville Tobacco BACKGROUND AND SUPPLEMENTAL INFORMATION: On October 24, 2024, Centerville Tobacco failed a tobacco compliance check conducted by Centennial Lakes Police Department. Employee Khaled Zouaoui sold tobacco products to CLPD decoy without questioning the decoy's age or asking for her ID. This employee was cited with petty misdemeanor Sale of Tobacco - Under 21 Years Old, and paid the citation fine on November 8, 2024. Centerville Tobacco does not have any prior tobacco sale violations. At this time, the City Attorney makes the following recommendations: Under the City Code, a first tobacco sale violation shall be assessed a fine in accordance of the fee schedule. Per the fee schedule, a first offense for tobacco sale violations is subject to a $250 fine. The City Attorney recommends this fine be imposed by resolution of the City Council.
