733 Marquette Avenue, Suite 1000, Minneapolis, MN 55402 <br />Planning Report <br />DATE:April 1, 2025 <br />TO:Centerville Planning & Zoning Commission <br />FROM:Phil Carlson, AICP,Stantec <br />RE:1421 Mound Trail, Variance Request Ï Garage & Swimming Pool <br />INTRODUCTION <br />The owner of the single family home at 1421 Mound Trail <br />has asked the Planning and Zoning Commission to <br />informally review their request for a variance for a new <br />garage and swimming pool on the lot.The request brings <br />up interesting questions on the interpretation of the <br />Centerville Zoning Code.At a previous meeting this was <br />discussed, but with a limited and rushed analysis of the <br />Code and the particular characteristics of this property. <br />This report sets out the Code standards and issues, <br />hopefully more completely. <br />The property is a lakeshore lot on Centerville Lake, about 105 ft wide by 350 ft deep. The house is <br />situated about 100 ft from the lakeshore, leaving a ÑfrontÒ yard about 200-220 ft deep between <br />the house and Mound Trail. There is little room on the lakeshore side to put in a new structure or <br />pool meeting setbacks, and the code isambiguouson the question of putting a garage and <br />swimming pool in the location requested. TheCity for many years has consistently interpreted the <br />Code to require swimming pools only in the rear yard. This report will offer a differentinterpretation. <br />Request <br />The request is illustrated on the nextpage. The applicant wants to construct a new detached <br />garage and swimming pool on the north side of the lot between the house and Mound Trail.This <br />location brings up several issues in the Code definitionsand standardswhich we recommend <br />reviewing and possibly amendingfor clarity. <br />Zoning Code Issues <br />The issues in the Code revolve around the definitions and understanding of the terms ÑsetbackÒ, <br />ÑyardÒ, and ÑstructureÒ. Definitions and standards from the Zoning Code are excerpted at the end <br />of this report.The Code says that Ñ no accessory structure shall be erected or located within any <br />required yard other than the rear yardÒ and that Ñswimming pools may exceed the size <br />requirements for accessory structures, but shall not exceed 50% of the rear yard.Ò <br /> <br />
