On February 28, 2025, staff emailed the proposed Special Assessment Agreement/Waiver of <br />Hearing & Appeal to the 1922 & 1932 Eagle Trail property owners for the second time. No <br />responses were received. <br />On April 15, 2025, staff contacted both property owners via telephone to ascertain their interest in <br />the project. The two property owners stated that they were not in favor of special assessments. <br />These property owners are the ones most affected by the construction activities, as the equipment <br />needs to be brought into their yards for the installation of the outlet and storm pipe. Both property <br />owners stated that they had items in their yards that would need to be moved (fence, irrigation, <br />planter box, trees, electrical box, etc.). Both property owners also felt that the property owner <br />experiencing the drainage issue purchased the home knowing that it abutted a pond, and that <br />individual solutions could be made by the property owner at 6996 Brian Drive. In addition, these <br />property owners felt that they were not experiencing the same conditions and that it did not appear <br />to be a neighborhood problem. <br />8 <br /> <br />
