The premium property valuation is driven by the <br />location and wooded privacy of Rice Creek Chain of Lakes Preserve across the street <br /> Applicant should not be allowed to take advantage of private location and lack of neighbors <br />across Mound Trail to justify a non-compliant front yard project <br />Applicant should not be allowed to negatively impact neighborhood character and property <br />values for own enjoyment of clearly out of place complex <br />ijŏąŗŏŹijŹƂđŏƂϼƜijƂİϼƂİđϼŹƇŵŵŗƇŏċijŏĩϼêŵđêЄ <br />There are 7 existing "front yard" structures on Mound Trail used by the applicant to set precedence for <br />this project. Attachment A - Current Front Yard Structures on Mound Trail. These structures are not <br />similar to the 1421 Mound Trail variance request: <br /> All 7 are garages <br /> The footprint of each garage is significantly smaller <br /> Garages are adjacent to each other or other yards rather than abutted to the neighbor's primary <br />structure <br /> There are no wet bars, full bathrooms, pool houses, recreational centers, golf simulators, two <br />stories with stairs, or front yard covered entertainment patios. Covered patio expressly denied in <br />2021 variance request. <br /> The 7 precedent garages could not reasonably be used as dwellings. <br /> There are no front yard fences on Mound Trail. The 1421 Mound project would require a 4 foot <br />fence in a front yard, also outside of Zoning Code. <br /> 6 of 7 garages were built decades ago, and the Commission considered location of structure, <br />character of locality, and impact to neighboring properties before approval. <br /> 2021 variance had size and height of garage reduced by Commission <br />Commission History of Honoring Zoning Code <br />I reviewed every single P&Z Commission Meeting Minutes document published from 2005-Present. <br />Residential variance decisions made by the Commission over the past 20 years demonstrate <br />consistency in enforcement of the Zoning Code of Ordinances and do not support this project. <br />Attachment B details the Commission's Decisions 2005-2025. <br />There are 3 accessory structures which were approved for front yards on lake properties, as noted in Rust <br />color on the supporting document. One of these is for the garage at 1313 Mound Trail and two are for <br />storage sheds. ALL considered the essential character of the locality and neighboring properties before <br />approval.
