June 3, 2025 <br />Centerville Planning & Zoning Commission <br />Page 7 of 7 <br />RE: Zoning Code Issues & Definitions <br /> <br />SWIMMING POOLS <br />Swimming pools are considered accessory uses. In Section 156.107(A)(10) the code stipulates: <br /> <br />(10) Swimming pools may exceed the size requirements for accessory structures, but shall not <br />exceed 50% of the rear yard. <br /> <br />This limits the size of swimming pools but does not explicitly state a swimming pool must be in the <br />back yard, which is the precedent in Centerville and my understanding of the intent of the code. I <br />suggest this section be amended as follows: <br /> <br /> Swimming pools may only be located in the rear yard, and may exceed the size requirements for <br />accessory structures, but shall not exceed 50% of the area of the rear yard. <br /> <br /> <br />CONCLUSION & RECOMMENDATION <br />If there is consensus among the Planning and Zoning Commission on the various issues presented <br />here, we will bring back zoning code amendments in ordinance form for a public hearing and <br />recommendation to the City Council at a later meeting. <br /> <br />11 <br /> <br />
