July 2, 2025 <br />Centerville City Council <br />Page 6 of 8 <br />RE: 7064 Centerville Road, Variances for New Detached Garage <br />156.052(C)(1) further states that accessory buildings (or decks/porches) can also be constructed, if <br />they meet the requirements of the R-2 zoning district. The proposed garage is set back five (5) feet <br />from the south side lot line; the R-2 zone requires a ten-foot setback from the side lot line for <br />principal structures (such as the house). If the garage were attached, the applicant would either <br />need to reduce the width of the garage or request a variance from the side setback. <br />VARIANCE STANDARDS <br />The processes and procedures for variances are covered under 156.310. The standards or criteria <br />the Planning and Zoning Commission and City Council consider when reviewing variances are <br />found in 156.310(A)(1). These are listed below in italics, with staffÔs findings following. <br />(1) The variance is in harmony with the purposes and intent of the zoning chapter of this <br />code; <br />a. This is not met. The current requirements are to have detached structures in the <br />rear yard, and a minimum distance from the primary residence. There are other <br />areas of the property that could be utilized for the proposed detached <br />accessory structure that would comply with city code. In addition, the <br />applicant could remove the existing shed on the site, further bringing the <br />property into code compliance and removing the need to vary from the limit <br />on aggregate accessory structure space. <br />(2) The variance is consistent with the comprehensive plan; <br />a. This is met. The 2040 Comprehensive Plan does not explicitly discuss accessory <br />structures. <br />(3) The proposal puts the property to use in a reasonable manner; <br />a. This is met. A detached accessory structure is permitted with residential uses. <br />(4) There are unique circumstances to the property not created by the landowner; <br />a. This is not met. While the houseÔs location deep in the lot and the gas meter <br />existed prior to the current owner, the applicant is proposing the proposed <br />location of the detached garage. There are other areas of the property that <br />could be utilized for the proposed detached accessory structure that would <br />comply with city code. <br />(5) The variance, if granted, will not alter the essential character of the locality; <br />a. This is met. There are other properties within the city that have detached <br />accessory structures within the front yard. The proposed location would not <br />Óstand outÔ when compared to the locations of the houses on the properties to <br />the north and south. <br />(6) Any person filing a petition requesting a variance or an amendment of the zoning <br />chapter rezoning property or changing regulations within any use district shall pay a <br />fee according to the schedule established by resolution or ordinance of the City <br />Council. The fee is payable at the time of filing a petition and is not refundable. <br />a. This has been met. <br />63 <br /> <br />
