143 <br />YARDSETBACK, SIDE. A yard between the sidelineof the lot and the nearest line of the building and <br />extending from the front yard to the rear yard.The area lying between the side lot line and extending <br />inwardly to the depth required in the setback regulations for the district in which the lot is located, and <br />which lies between the front and rear setbacks, or other applicable setbacks. <br />SETBACK, STREET SIDE.The area extending between the front setback and the rear setback, and to the <br />depth required in the setback regulations for the district in which it is located. <br />SWIMMING POOLS.Any pool, tank, or other structure, above or below ground,which shall cause or has <br />the capacity to retain water ata depth greater than 30 inches, and is designed to be used for swimming, <br />wading, or immersion purposes by individuals. <br />YARD. A requiredTheopen space on a lot which is unoccupied and unobstructed from the ground upward, <br />except as otherwise provided for herein. The measurement of a YARD shall beconstrued as the minimum <br />horizontal distance between thealot line and theabuilding line or edge of a structureline. <br />YARD, REAR. The portion of the yard on the same lot with the principal building located between the rear <br />lineedgeor building lineof the building and the rear lot line,andextending for the full width of the lot. <br />YARD, SIDE. A yard between the sidelot line of the lot and the nearest edge or building lineof the <br />building and extending from the front setbackyard to the rear setbackyard. <br />Section 2. Revisions to § 156.040(C) INDUSTRIAL DISTRICT (I-1). <br />(C) Setbacks.Specific setbacks are set forth in Appendix A, Table 1, District Regulations Lot and <br />Yard Requirements. In addition, side yards facing streets on corner lots shall be considered the <br />same asafront lot lineyards. Where a front setbackyardor side setbackyardof a corner lot faces <br />a residential district across a street, thesetback from the street shall be not less than 60 feet. <br /> <br />Section 2. Revisions to § 156.107(A)(4-5), (10), and (B)(4)ACCESSORY STRUCTURES <br />AND USES. <br />(4)No accessory structure shall be erected or located within any required yard other than the rear <br />yard.Any detached accessory structure that is not a garage shall be located only within the <br />rear yard. For detached garages, the following shall apply: <br />(a)On an interiorlot,no detached garageshall be erected or located so that any edge or <br />building line of the structure is in front of the principal building. <br />(b)On a cornerlot, a detached garage or accessory building shall be permitted closer to <br />the nonprimary front lot line than the front building line or edge of the principal <br />building, provided that the minimum front setback for principal buildings is met, <br />there is screening between the structure and the right-of-way, and that all other <br />required setbacks are met.The Zoning Administrator may identifythe primary front <br />lot line. <br />(c)On a lakeshore lot, a detached garage or accessory building shall be permitted closer <br />to the front lot line than the front building line or edge of the principal building, <br />provided that the minimum front setback for principal buildings is met, there is <br />screening between the structure and the right-of-way, and that all other required <br />setbacks are met. <br /> <br />
