FINDINGS OF FACT FOR CONDITIONAL USE PERMIT <br /> <br />The Planning and Zoning Commission and the City Council made these Findings of Fact in <br />support of the recommendation and approval of this Conditional Use Permit: <br /> <br />1)That the applicant has submitted requests to the City of Centerville for a Conditional <br /> <br />ƭĻ tĻƩƒźƷ Λ/ <br />tΜ źƓ ğĭĭƚƩķğƓĭĻ ǞźƷŷ ƷŷĻ ƦƩƚĭĻķǒƩĻƭ ğƭ ĻƭƷğĬƌźƭŷĻķ ĬǤ /ĻƓƷĻƩǝźƌƌĻƭ /źƷǤ <br />Code. <br />2)A Conditional Use Permit is required under City Code Section 156.166 (E) for property <br />owners to receive flexibility to the number of required parking stalls in City Code; and <br />3)That the request for flexibility is consistent with the overall goals and objectives of the <br />Centerville Comprehensive Plan. <br />4)That the proposed flexibility is necessary to reasonably establish a new commercial <br />retail use on the property, and the use is expected to contribute to the general welfare <br />of the City. <br />5)That the request would allow for flexibility to parking standards which will not have a <br />substantial or undue adverse effect on adjacent property, the character of the <br />surrounding neighborhood and the general health, safety, and welfare of the City; and <br />6)That the proposed flexibility, with conditions as imposed by the City, will allow for <br />establishment of a retail use which is arranged and operated in accordance with <br />applicable regulations. <br /> <br />CONDITIONAL USE PERMIT CONDITIONS <br /> <br />The City of Centerville hereby grants the Subject Property and Landowner a CONDITIONAL USE <br />PERMIT, subject to the following conditions: <br /> <br />1)This Conditional Use Permit is intended to allow flexibility to the standards for retail <br />uses only. Should another use requiring flexibility to the parking standards be proposed, <br />an amendment to the CUP is required. <br />2)The Retail use may include a maximum of 30% of the floor area for walk in customer <br />sales. If a higher amount of floor area is desired for walk in sales, an amendment to the <br />CUP is required. <br />3)Parking area improvements shall not be located within any drainage and utility <br />easement areas unless otherwise approved by the City. <br />4)Use of the parking area is limited to the daily parking of operable, licensed, vehicles <br />unless otherwise approved by the City. <br />5)Prior to establishing the retail use, the Property Owner must bring the parking lot into <br />conformance with City standards for poured in place curbing and bituminous surface. <br />6)The Applicant must obtain and maintain all applicable permits and licenses to improve <br />the property and operate the commercial use on the subject property. <br /> <br /> <br /> <br />2 <br />Centerville Condional Use Permit <br />Approved 04/16/2026 <br />73 <br /> <br />
