ENCROACHMENT AGREEMENT <br />AGREEMENT ("Agreement') was made this Af'41 day of April, 2026, by and between the <br />CITY OF CENTERVILLE, a Minnesota municipal corporation ("City"), and Tani E Pariscau <br />and Dale J Pariseau, a married couple who have entered into a JRL Trust ("Landowners") <br />RECITALS <br />A. Landowners owner in fee as tenant the real property situated in Anoka County, <br />Minnesota, legally described as follows (`:Subject Property"): <br />PIN #23-31-22-34-0004 <br />1707 Dupre Road <br />LOT 1, BLOCK 1 <br />PHEASANT MARSH IsT ADD, SUBJ TO <br />EASE OF REC <br />B. Landowners desire to construct a 5', black, chain link fence within the rear and <br />side; yard setbacks within the city's right-of-way/drainage and utility easements. Landowner(s) <br />seeks permission from the City to enc.-roach in the City's tight-of-way/drainage and utility <br />easements as follows::. commencing approximately 86.42' from the rear fayade of the garage, <br />traveling easterly 9' toward the side lot line encroaching the city right-of-way/drainage and <br />utility easement by 3% then commencing south along said line to the rear of the property <br />remaining 3' from the easterly side lot line by approximately 44', then commencing westerly <br />19'; then heading diagonally 87' northwesterly then commencing 28' to its end. The fence will <br />then be constructed fioni the rear fagade of the home and head westerly to the property line by <br />32' encroaching the right-of-way/drainage and utility easement by 3'. <br />1 <br />
