<br />; <br /> <br />INSTALLATION <br /> <br />The hot asphalt is applied with a paving machine. This machine operates on the same principle of those used <br />on freeways. It lays a mat of asphalt of uniform consistency. The mat is then rolled to density while hot <br />(2500F). To gain this density the roller "squeezes" the mat to a thickness of 3 inches. It is important to note <br />that even at a maximum density, the aggregate or stones may be seen near the surface. In areas where the <br />material is installed by hand, the aggregate can be seen more prominently. This situation is certainly a <br />normal one. In fact the more coarse aggregate in the asphalt mix, the stronger it is, the longer it will stand up <br />and the less maintenance it will require. <br /> <br />CRACKING <br /> <br />In Minnesota, the frost penetrates the ground as deep as 3 to 4 feet. The ground, when frozen this deep, will <br />heave sometimes as much as 1 or 2 inches. An asphalt mat will give or move to a certain extent, then it will <br />crack and separate. These cracks are generally quite straight and go clear across the surface of the lot or <br />driveway. The crack can be seen continuing into the lawn away from the pavement. No matter how strong <br />the asphalt pavement is constructed, Mother Nature is stronger. Even our best highways acquire many <br />expansion cracks. We suggest that these cracks be left alone as they will close up to a certain extent in the <br />spring. The highway department fills them because of the extreIl)e level of high speed traffic. In past years <br />we have not had a problem with breakup due to these expansion cracks. <br /> <br />GUARANTEE <br /> <br />We guarantee all of our driveways for two years against defective materials and workmanship, including: <br /> <br />1. Excessive cracking due to faulty installation or materials. Note: asphalt driveways <br />will acquire expansion cracks due to severe freezing like Minnesota's best asphalt <br />highways acquire. This is a normal situation in this climate and is not essentially <br />detrimental to the life expectancy of a residential driveway. When a new mat is laid <br />over an existing asphalt or concrete driveway, cracks from the existing driveway may <br />reappear on the new drive. <br /> <br />2. Chuckholes and breakup. <br /> <br />3. Faulty mix. <br /> <br />Our guarantee does not cover inconsistencies in asphalt texture; settling due to previous excavation or back <br />filling; holes due to asphalt enemies such as gas, oil, antifreeze, turpentine, or other petroleum products <br />spilled on the asphalt; tire marks, bicycle kick stands, heel indents, ladders or other sharp objects. <br />Guarantee does not cover water puddles without a 1.5% grade for drainage. <br /> <br />Salt will not harm asphalt in any way. <br /> <br />NOTICE OF LIEN RIGHTS <br /> <br />PERSONS OR COMPANIES FURNISHING LABOR OR MATERIALS FOR THE IMPROVEMENT OF REAL PROPERTY <br />MAY ENFORCE A LIEN UPON THE IMPROVED LAND IF THEY ARE NOT PAID FOR THEIR CONTRIBUTIONS, EVEN <br />IF SUCH PARTIES HAVE NO CONTRACTUAL RELATIONSHIP WITH THE OWNER. MINNESOTA LAW PERMITS THE <br />OWNER TO WITHHOLD FROM HIS CONTRACTOR AS MUCH OF THE CONTRACT PRICE AS MAY BE NECESSARY <br />TO MEET DEMANDS OF ALL LIEN CLAIMANTS, PAY DIRECTLY SUCH LIENS AND DEDUCT THE COST OF THEM <br />FROM THE CONTRACT PRICE, OR WITHHOLD AMOUNTS FROM HIS CONTRACTOR UNTIL THE EXPIRATION OF <br />ONE HUNDRED TWENTY (120) DAYS FROM THE COMPLETION OF SUCH IMPROVEMENTS UNLESS THE CON- <br />TRACTOR FURNISHES TO THE OWNER WAIVERS OF CLAIMS FROM MECHANICS' LIENS SIGNED BY PERSONS <br />WHO FURNISHED LABOR OR MATERIALS FOR THE IMPROVEMENT AND WHO PROVIDED THE OWNER WITH <br />TIMELY NOTICE.
