(651) 429-8629 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF ANOKA <br />CITY OF CENTERVILLE <br /> <br />RESOLUTION ~7 <br /> <br />RESOLUTION ESTABLISHING A DEED RESTRICTION ON LAND PURCHASED WITH <br />DEPARTMENT OF NATURAL RESOURCES GRANT FUNDS <br />- GRANT PROJECT OR07-002 - <br /> <br />WHEREAS, the City of Centerville was awarded a Department of Natural Resources grant to purchase land restricted by <br />Grant Project OR07-002; and <br /> <br />WHEREAS, the grant agreement related to the grant project has a deed restriction requirement for the property described <br />as: <br /> <br />The northeasterly 112.5 feet of the following described property: <br /> <br />That part of the Southeast Quarter (SE ~) of Section 22, Township 31 North, Range 22 West of the fourth <br />principal meridian and that part of the Southwest Quarter (SW ~) of Section 23, Township 31 North, Range 22 <br />West of the fourth principal meridian described as follows: <br /> <br />Commencing at the Northwest comer of the Southwest Quarter of said Section 23; thence South on the west line <br />of said Section 23 to the southwest comer of the Northwest Quarter of the Southwest Quarter of said Section 23; <br />thence East 24.75 feet; thence North parallel with the west line of said Section 23 to a point 249.2 feet south of <br />the north line of the Southwest Quarter of said Section 23, to the point of beginning said point being the <br />intersection of the northwesterly right-of-way line of LaMotte Road as established per the plat of LAMOTfES <br />SECOND ADDITION; thence North 39 degrees 41 minutes 45 seconds East along said northwesterly right-of- <br />way line of LaMotte Road a distance of 186.76 feet; thence North 50 degrees 29 minutes 27 seconds West a <br />distance of 250.86 feet to the Low Water Mark of Centerville Lake (883.27) - Lowest recorded water elevation <br />per Minnesota Department of Natural Resources; thence southerly along the Low Water Mark to its intersection <br />with the northwesterly extension of the north line of Lot 1, Block 1, LAMOTTES SECOND ADDITION; thence <br />South 50 degrees 29 minutes 27 seconds East along said north line of Lot 1 a distance of 238.25 feet to the <br />northwesterly right-of-way line of said LaMotte Road as measured along the north line of said Lot 1, Block 1; <br />thence North 39 degrees 41 minutes 45 seconds East along said northwesterly right-of-way of LaMotte Road <br />38.24 feet to the point of beginning, containing 0.42 acres, more or less. <br /> <br />NOW, THEREFORE, IT IS HEREBY RESOLVED, that the City ofCenterville. pursuant to Grant Project OR07-OO2 <br />shall manage and maintain property consistent with the purpose and type of property acquired using appropriate <br />management and protection practices to protect the natural. recreational and/or scenic resources; and, shall not at any time <br />convert any portion of the natural recreational and/or scenic area to uses other than permitted in the grant agreement <br />without prior written approval of the State. <br /> <br />PASSED AND ADOPTED by the City Council this 13th day of December, 2006. <br /> <br />'::!!!4!}- C"~ <br /> <br />Attest: ........- ~ <br />C.hh_~~ J <br />City Clerk, Teresa Bender <br />
